Dems Introduce Comprehensive Immigration Reform Bill


"On 10/02/2013 the Democratic leadership in the House held a press conference to announce their introduction of a comprehensive immigration reform bill modeled after the successful bipartisan Senate bill, S.744. The legislation's original sponsors: Reps. Chu (CA), Polis (CO), Horsford (NV) and DelBene (WA), all spoke in support of the need for reform now.
12:08pm Democratic leaders take the stage to introduce a comprehensive immigration bill, these leaders include Democratic Conference Chair Becerra (CA), Minority Leader Pelosi (CA), Minority Whip Hoyer (MD), and Reps. Garcia (FL), Polis (CO), Crowley (NY), and Chu (CA), among others.

Rep. Becerra: Fixing the broken immigration system will help us fix this budget system, because as the Congressional Budget Office told us, Senate bill 744 will reduce the deficit by $135 billion over the next decade. We're ready to move, we believe we're going to have many, many supporters of this legislation. We want to prove to our Republican colleagues that we're ready to move, by presenting a piece of legislation that isn't just the Democrats dream come true, but that represents bipartisan compromise including components of the bipartisan Senate bill and the border security bill from the House Homeland Security Committee.

Minority Leader Pelosi: This isn't an issue, it's a value, it's an ethic, it's about who we are as a people. This bill is 100% bipartisan, we took the Senate bill, subtracted Corker-Hoeven, and added in the McCaul border security bill. We believe that every new comers to our country that brings dreams, aspirations, makes American more prosperous and rich.

Rep. Garcia: During the last year Americans from across the country sent a message loud and clear that we want immigration reform. That message was heard in the Senate, but has not yet been heard in the House. The only way immigration reform can pass is if Democrats and Republicans work together. We aren't introducing a perfect bill, we've taken out the very controversial Corker-Hoeven border surge amendment, that had many opponents in both parties and replaced it with the detailed bipartisan McCaul border security bill that passed unanimously out of the House Homeland Security Committee. Everyone from Regan to Bush championed immigration reform, and there is no reason we can't do it now.

Chu: I'm proud to be an original cosponsor of this bill, it is long overdue and the need is great. It's been three long decades since we've addressed our outdated immigration system that tears families apart. Asian Pacific Islanders make up more than 40% of those caught in the broken immigration system. The senate bill isn't perfect, for example, it phases out the sibling category in the family immigration system, but there are many benefits including clearing the backlogs within the next eight years. We cannot let the perfect be the enemy of the good, this bill include bipartisan measures that passed the senate.

Rep. Horsford: There is a broad and diverse coalition that understands how serious this is. In my district we have DREAMers that if we fail to act will have to continue to live in their shadows. Today, we ask our House Republicans: no more waiting. This is a legislative solution that has bipartisan support.

Rep. DelBene: We have a historic opportunity to help our economy, business and families. My district in Washington state is representative of why we need reform: we have an incredibly diverse economy, rich agriculture and technology (Nintendo, Microsoft and startups) these businesses have been making a strong case to Congress making the case for immigration reform. we can't settle for a piecemeal approach, our policy is too complex, if we tweak if one area it will inevitably have consequences elsewhere. We must help both our farmers and our farmworkers at the same time.

Rep. Polis: What a better issue to show we can come together in a bipartisan fashion to solve the biggest issue facing us as a country. This legislation not only unites families, but it makes America more competitive. The economic benefits are enormous, this bill would decrease the federal deficit by over $135 billion over the next decade, and over a trillion dollars in the next twenty years. Delaying consideration of immigration reform is no longer an option.

RESPONSES TO QUESTIONS:
Rep. Becerra: What we're putting forward is a bill that has received Republican votes, we could have put forward a bill that would have gotten 200 Democrat votes, but we wanted to put a bill forward that showed we were serious about moving this forward. What we're saying, is on the Democratic side, we're ready. There is no reason to have dysfunction rule the day.

Rep. Crowley: We are more than prepared to move forward, let's move on to the nitty gritty tasks of getting this passed.

Rep. Pelosi: Democrats may vote for a bill that doesn't include a path to citizenship, but when it leaves the conference table as a comprehensive bill it must include a path to citizenship because that's the right thing for America."

WARNING of SCAM by USCIS

WARNING----USCIS has learned about a new telephone scam targeting USCIS applicants and petitioners. Scammers are using a technique called "Caller ID spoofing" to display false information on the recipient's Caller ID, leading the individual to believe that the caller is a USCIS official. Be aware of these types of scams and alert your clients that USCIS will never ask for any form of payment or personal information over the phone.

Rep. King appears to be an extremist xenophobe as he slams Norquist's pro-immigration stance on a U.S. citizenship pathway for DREAMers:

 "He cites those illegals who were brought to the United States by their parents as young children, for instance."

"Some of them are valedictorians — and their parents brought them in. It wasn't their fault. It's true in some cases, but they aren't all valedictorians. They weren't all brought in by their parents."

"For everyone who's a valedictorian, there's another 100 out there who weigh 130 pounds — and they’ve got hands the size of cantaloupes because they're hauling 75 pounds of marijuana across the desert,” King tells Newsmax.

Unbelievable that a U.S. Rep. from Iowa is so extreme and mean-spirited against children who are aspiring Americans!

Hands states and localities the power to pass and enforce their own criminal and civil penalties for immigration violations.  The provision is in direct opposition to the Supreme Court’s ruling last year over Arizona’s SB 1070.
Authorize all local police to act as immigration agents, essentially nationalizing the 287(g) program, which has been widely criticized for encouraging racial profiling and eroding police-community trust.  
Lets local cops detain immigrants in their jails for up to two weeks and then requires ICE to lock up all immigrants that local cops detain.
Expands the kinds and categories of crimes that make people mandatorily deportable, without recourse to a judge. This would include people the government “has reason to believe” have ever been a member of a gang, even without a conviction."

Trey Gowdy, R-SC.  But unlike the Senate immigration reform package that would legalize millions of undocumented immigrants while also expanding border and workplace enforcement, the Gowdy bill does only the later, and in the worst way. The SAFE Act, as it’s called, would vastly expand immigration enforcement programs, curtail legal rights of non-citizens and authorize state and local law enforcement to act like immigration agents whenever they want to.

""A court challenge by federal immigration agents seeking to block President Barack Obama’s deferred-deportation initiative will probably succeed, a judge said.  U.S. District Judge Reed O’Connor in Dallas today put off his own decision on whether to grant the request for a preliminary injunction by 10 U.S. Immigration and Customs agents.  He asked both sides to file additional arguments no later than May 6. ...  “The court finds that DHS does not have discretion to refuse to initiate removal proceedings” when the requirements for deportation under a federal statute are met, O’Connor said today in a 38-page decision, referring to the Department of Homeland Security.  Still, the judge said he can’t decide the case based on the arguments he’s heard so far.  “Accordingly, the court hereby defers ruling on the plaintiffs’ application for preliminary injunction until the parties have submitted additional briefing,” O’Connor said.""

"Late last week opponents of comprehensive immigration reform began to exploit the Boston Marathon bombing," Leahy said at the second Senate Judiciary Committee hearing on an immigration bill released last week by the "gang of eight." "I urge restraint in that regard. ... Let no one be so cruel as to try to use the heinous acts of two young men last week to derail the dreams and futures of millions of hardworking people.""

AILA's 8 Points from the Senate Immigration Bill


AILA's 8 Points from the Senate Immigration Bill

"AILA issued this press release commending the Senators for their work on the bill...here are but a few things S.744 would do:

1.    Legalization: Allow noncitizens who are unlawfully present and who entered the U.S. before December 31, 2011 to adjust status to that of Registered Provisional Immigrant (RPI). Eligible applicants would be required to pay a penalty and back taxes. Individuals in RPI status would receive work authorization and may travel abroad. They would also become eligible to apply for LPR status after 10 years, and can apply for naturalization 3 years after acquiring a green card. Includes generous provisions for DREAMers and agricultural workers.


2.    Family-Based Immigrants: Move the current FB-2A category into the immediate relative classification, allow for derivatives of immediate relatives, eliminate the FB-4 category, cap the age of eligibility of married sons and daughters of U.S. citizens at 31, and bring back the V visa.


3.    Employment-Based Immigrants: Exempt the following categories from the quota: EB-1 immigrants, doctoral degree holders, physicians who have completed the foreign residency requirement, and derivatives. Add a new "EB-6" category for certain entrepreneurs.


4.    Temporary Workers: Create a W-1 visa for lesser-skilled workers, a W-2 visa for aliens coming to the U.S. temporarily to perform agricultural services or labor under a written contract, and a W-3 visa for "at-will" workers with an offer of full-time employment in an agricultural occupation. The W-2 and W-3 visas would replace the current H-2A agricultural worker program.


5.    Asylum: Eliminate the one-year filing deadline and authorize asylum officers to grant asylum during credible fear interviews.


6.    E-Verify: Require all employers to be on the system after 5 years.


7.    H-1Bs: Increase the quota to a floor of 110,000 and a ceiling of 180,000, increase the U.S. advanced degree exemption to 25,000 but limit it to STEM graduates, add a recruitment requirement for all H-1B labor condition applications involving a detailed posting on an Internet site designed by the Labor Department, add a non-displacement attestation, change the prevailing wage formula, provide EADs for spouses, and add a 60-day grace period after an H-1B has been terminated from his or her job.


8.    Fraud: Make it a crime to knowingly defraud an immigrant or hold oneself out as an attorney or BIA accredited representative when one is not authorized to do so. Require the identification of individuals who assist immigrants with the completion of forms and empower the Attorney General with injunctive authority to act against an unscrupulous "immigration service provider" at the federal level."
